Timothy Dennis, Chief Assistant Attorney General, and Jeanette Moffa, Partner at Moffa Tax Law, To Present Florida Bar CLE on State Tax

Timothy Dennis, Chief Assistant Attorney General of the Revenue Litigation Bureau in the Florida Office of the Attorney General, and Jeanette Moffa, Partner at Moffa Tax Law, will be providing a continuing legal education (CLE) course on February 12, 2025. This is the first time in many years that the Florida Bar Tax Section and Florida Government Lawyer Section have co-hosted a CLE.
 

CLE 8807 Florida State Tax Procedure & Dispute Resolution

This one-hour CLE, titled “Florida State Tax Procedure & Dispute Resolution,” will take place February 12, 2025, from 12pm-1pm. The course will provide attendees with the unique opportunity of learning the procedure of state tax cases as well as some of the options for resolving them from attorneys versed in representing both sides of Florida tax disputes. Registration is free for members of the Florida Bar Tax Section and Florida Government Lawyer Section. The full course description and learning objectives are below: 

 

State tax law is known for its complexity. Practitioners are asked to reconcile numerous complex, and sometimes seemingly-conflicting, state laws and rules to establish the taxability (or not) of sales or income. In all the confusion, it is easy to forget the other side of the coin: procedure. From audit through litigation, state tax procedure is highly technical with rules that are easy to overlook. This joint CLE between the Florida Bar Tax Section and Florida Bar Government Lawyers Section is designed to provide the details of state tax procedure from audit through litigation.

Learning Objectives:
Understand state tax procedure from audit through litigation
Identify and describe several audit types
Evaluate informal protest options prior to formal challenge to tax decisions
Compare the Division of Administrative Hearings with Circuit Court
Analyze litigation and settlement considerations

 

Speakers

Timothy “Tim” Dennis has served as the Chief Assistant Attorney General of the Revenue Litigation Bureau in the Florida Office of the Attorney General since 2014. In that role, he leads the operations of a 16-person statewide team that represents the Florida Department of Revenue in cases involving tax assessments, refund claims, and property tax matters. He previously served as an Assistant Attorney General in the Revenue Litigation Bureau and Administrative Law Bureau. Prior to joining the Attorney General’s Office, Mr. Dennis worked in the public and private sector handling land use and environmental law matters, representing clients before federal, state, and local government agencies. Tim is also a long-time member of the Government Lawyer Section’s Executive Council, currently serving as the District One representative.

Jeanette Moffa is a Florida state and local tax lawyer. She provides SALT planning and consulting as part of her practice, addressing issues such as nexus, apportionment, and taxability, including exemptions, exclusions, and inclusions of transactions and income from the tax base. In addition, she handles tax controversy and litigation of both state and local tax and administrative law issues. She is the author of the CCH Treatise on Sales and Use Tax, and contributing author of the ABA’s Sales and Use Tax Deskbook, Florida Bar’s Florida Administrative Practice, and ABA SALT Committee’s Connexus. She is a director of the State Tax Division of the Florida Bar Tax Section, executive council member of the ABA State and Local Tax Committee, and committee planning member of various state tax conferences across the country.
